Man Accused of Stalking Miley Cyrus is Set Free

Despite not talking on the subject for quite some time, you may remember some months ago how Miley Cyrus was being stalked while filming The Last Song in Georgia by a 53-year-old man.

For months, Mark McLeod has been in jail awaiting a court case, that case was brought to court yesterday in Chatham County.

The Chatham County Grand Jury decided prosecuters had insufficient evidence to charge the alleged Miley Cyrus Stalker in the Superior Court. Despite this, a spokeswoman for District Attorney Larry Chisolm said he still plans to prosecute Mr McLeod on two misdemeanor charges of attempted stalking and disorderly conduct.

Mark McLeod has been in jail since 4th August after police arrested him for the second time in as many weeks on Tybee Island, where Miley Cyrus was filming her latest movie, The Last Song, which hits Cinema’s next April.

When arrested, Mr McLeod told police that he was secretly engaged to marry Miley Cyrus, and that Miley had been sending him secret messages via her ‘Hannah Montana’ TV show for him to come and see her.

James Byrne, McLeod’s attorney, said he felt: “vindicated, a little bit” by the grand jury’s refusal to indict. He said he suspects McLeod may suffer from mental delusions, but never posed a real threat to Miley.

“The grand jury showed some common sense, which no one else in this case seems to have, which is there’s nothing to these charges,” Byrne said. “He didn’t stalk anyone, he didn’t threaten anyone. He acted strangely, and that’s why he’s in jail.“

McLeod initially was charged with only misdemeanors, but prosecutors had his case transferred to Superior Court last month so they could pursue a felony charge of obstruction of a police officer. They said he tried to head butt an officer who tried to lead him away, but the grand jury rejected it as a felony case.

McLeod remained jailed Wednesday on $55,200 bond, which Byrne says the unemployed assistant plumber and his family can’t afford. Byrne said he planned to ask a judge to lower McLeod’s bond once the misdemeanor charges are refiled.
